Who these terms are between

This store is operated by JSC Products ("The Kind Wardrobe", "we", "us"). By browsing or ordering from thekindwardrobe.com you agree to these terms. If you do not agree with them, please do not use the store.

Who can order

You must be at least 18 and able to enter a contract. We sell to consumers in Australia for personal use, not for resale.

Products and descriptions

We describe every item as accurately as we can, including its composition and measurements where the supplier provides them. Screens render colour differently, so a shade may vary slightly from what you see. A slight variation of that kind does not by itself make an item faulty, though it is of course still returnable under our returns policy.

Availability and pricing

All prices are shown in Australian dollars (AUD). No GST is charged, because we are not registered for GST in Australia, and parcels valued at AUD 1,000 or less are not charged import duty or GST at the border. An order worth more than AUD 1,000 can attract import duty and GST, which are payable by the customer. Prices can change, but never after you have placed an order. Stock is limited and an item may sell out between your order and our packing it; if that happens we refund that item in full and tell you the same day. If a price is listed in obvious error we contact you before dispatch, and you may confirm at the correct price or cancel.

Orders and payment

Your order is an offer to buy. The contract is formed when we send the dispatch confirmation. Your card is authorised at checkout and charged when the order is confirmed. Accepted methods are listed in our payment policy.

Delivery

Delivery times and costs are set out in our shipping policy. The published timeframes are estimates based on what our couriers actually achieve; they are not guarantees, and a delay does not entitle us to keep your money if the order never arrives.

Returns

Set out in full in our returns and refunds policy, which forms part of these terms.

Your account

If you create an account, keep your password to yourself. You are responsible for what happens under your login. Tell us straight away if you think someone else has access.

Acceptable use

Do not use this store to break the law, to send malicious code, to scrape it at a scale that degrades it for other people, to impersonate anyone, or to interfere with how it works. We may suspend access where any of that happens.

Content and intellectual property

The text, layout and branding on this store belong to us or to our suppliers and may not be copied for commercial use. If you send us a photo or review, you allow us to show it in connection with the product, and you confirm it is yours to give.

Third-party services

This store runs on Shopify, and payments, hosting and some analytics are handled by third parties. Their own terms cover what they do. We are not responsible for third-party websites we link to.

Your personal data

What we collect and what we do with it is set out in our privacy policy, and the cookies this store sets are listed in our cookie policy. Both form part of these terms.

Liability

Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law, including the consumer guarantees, or any other liability that cannot be excluded by law. Where the law allows us to limit our liability, it is limited to what you paid for the order concerned.

If part of these terms fails

If a court finds any clause unenforceable, the rest stays in force.

Ending the agreement

Either of us may stop using the other's services at any time. Obligations that have already arisen still stand, whether that is an order we owe you or payment you owe us.

Changes

We may update these terms. The version published here when you place an order is the version that governs it.

Governing law

These terms are governed by the law of the Netherlands, where our company is registered. This does not remove any protection you have under the Australian Consumer Law or any other law of the place you live that cannot be excluded by agreement.
